The manuscript is medium-sized approximately 220 x 75 mm.

It is bound in a handsome, 20th-century black morocco binding that may have been done for HLS. Gold stamp-work on the spine announces that it contains ‘Statuta nova’ and the front cover proclaims in gold its ownership by the Harvard Law Library.

The script and decorative program are best discussed after considering the foliation and the quiring.

There are two non-medieval pencilled foliations in the manuscript, one in the upper-right hand corner, the other in the lower left. The one in the upper-right seems to have begun on seq. 12, which is the first folio of the original manuscript, ignoring what was probably the original parchment cover. The one in the lower-left seems to have begun one folio earlier, and so includes the original parchment cover. Something went wrong with the foliation on the upper-right because they both end up at fol. 324. Both foliations omit the modern end papers at the front and back. The one in the upper-right is visible only occasionally, and may have been rubbed out with use, or deliberately erased, on most of the folios. The one in the lower-left may be complete but is visible only occasionally on the images. Our initial digital foliation began with the first folio that has entered text (as opposed to doodles and notes of previous owners), and ended up with 322, ignoring the endpapers at the back. It seemed best to go back scheme reflected in the lower-left (which Baker follows), and so our digital foliation now gives us a total of 324, matching Baker and HOLLIS.

After what is probably the original cover page and an original freestanding end page, there is a duernion (our fols. 3–6), the first folio of which contains a statute of 8 Hen. 6, not laid out in the way the rest of the manuscript is laid out. The remaining folios of the quire are blank.

The first folio of the table (fol. 7r) has a quire signature that is probably contemporary with the manuscript: ‘aj’. The quire signatures in the rest of the manuscript are only occasionally legible (there is none legible in the third alphabet), but enough of them are legible to show that the table section is made up of 5 quires, all quaternions, numbered from a–e. The table ends at fol. 32r (sig. d2r). Fol. 32v is blank. Beginning on fol. 33r and occupying the rest of signature d and most of signature e (fols. 42v through 46v are blank) is additional material, for the most part not found in the statute book proper, from the first half of the reign of Edward III. This material is not laid out in the way that the rest of manuscript is laid out, but the scripts are similar. This material is not listed in the Table of Contents.

A new alphabet of quires begins with the statute book proper. It runs through an entire alphabet and through el in the next alphabet. All of the quires in these two alphabets are quaternions with the following exceptions: A folio has been tipped in at the end of quire e of the first alphabet in order to insert the conclusion of the ordinance of Labourers (S.R. 1:309). I/j in the same alphabet (fols. 112 to 113) is a bifolium. There is nothing about the text here that would suggest that it is an insertion. There is a bifolium at the end of statutes of Richard II containing the last of the statutes and two blank pages (fol. 216–17). There is a duernion in the middle of the statutes of Henry IV for no discernable reason (fol. 242–5). The statutes of Henry V end with bifolium, the second of which is blank (fol. 294–5).

The index begins a fourth set of signatures, curiously marked as ‘b’, ‘a’, and ‘c’. The first two are quaternions; the third is more of a problem. The index ends on fol. 316r; the remaining folios are basically blank. Folios, perhaps more than one, have been cut out after fol. 318 and 322. Without disbinding the manuscript, something that is not likely to happen any time soon, we cannot be sure, but we offer the following tentative collation.

Beginning at fol. 47r, the manuscript is laid out in pencil, with space for headers and footers, and a text block that is not lined. The scribe generally wrote 32 lines of text in this block, but there are a number of exceptions. The layout appears on most of the blank pages in the main manuscript.

Most, but not all of the pages have headers that give the name of the king and the regnal year. Some of these have been added by a later and more informal hand. The headings generally give just the regnal year of the statute, though some of the statutes have been given names.

The table, the statute book proper, and the index are all in the same style, with red and blue paragraph marks and occasional red and blue decorated capitals with fine scrollwork running into the margins. The quiring indicates that they could be separate pieces, but the hands are similar if not the same. The statute of Henry VI and the material from early in the reign of Edward III is not in the same style. The hand is similar, though perhaps not the same. The quiring of both indicates that they were not part of the original plan, though the script also indicates that they were done at approximately the same time. In particular, the script of the statute of Henry VI does not display many of the features that are frequently found scripts that are as late 1429–30 (8 Hen. 6).

There is one indication that the statutes of Henry V were a somewhat later addition, or that the scribe was getting tired. Up to fol. 276v, the statute book proper has as a header with a colored paragraph mark and the regnal year of the king in which the statute was made. Fol. 276v has ‘anno H quinti secundo’. Folio 277r has the paragraph mark, but the regnal year is blank. Beginning on fol. 277v, a somewhat later and more informal hand has supplied the regnal year using Hindu-Arabic numerals, e.g., ‘2 H. 5’.

There is also some evidence that the some, perhaps quite a bit, of the Edward III material is copied from an earlier collection. The fact that the signs in the marginalia that seem to refer to the initial collection of Edward III material are not found in that collection might suggest as much. Perhaps even more telling is that the index refers to Edward III as the king ‘quore est’, a designation that clearly does not apply to the time of Henry V or VI.

The interest of this collection does not lie in the basic statutes themselves, most, if not all, of which largely correspond to what is on the statute roll. The interest rather lies in the what was done with them. There are numerous corrections to the basic text of the statutes. Considerable effort was made to get everything. Notes of what is missing appear in several places in the manuscript. Some, perhaps all, of these are included in the collection at the beginning, though without, as previously noted, the signs under which the notes say they will be found. The collection of material from first half of the reign of Edward III is particularly interesting in that it contains much that is not found in S.R. The summaries of the statutes that appear in the table of contents and in the margins of the manuscript differ from each other. Marginalia (we may not have caught all of these) indicate ‘dampna in triplo’. This may be compared with the list of statutes that provide for multiple damages that appears at the end of MS 177. Several minds seem to be at work here.

Our notes are by no means complete. We made some effort with the first couple of statutes to transcribe the marginalia that appear in the statute book proper, but much more could be done. We did a bit more with the lemmata of the index, the results of which showed that the index substantially duplicates that in HLS MS 40. (See further immediately below.) There seems little doubt that the minds involved here are those of 14th- or early 15th-century lawyers. Now that the manuscript has been made available online we hope that others will use it to pursue this topic. We would appreciate learning of the results of any studies, whether large or small.

So far as we been able to discover, the alphabetical index is largely the same as that in MS 40. With two exceptions, the lemmata are the same, and they proceed in the same order. Again with a couple of exceptions and so far as we have been able to discover, the statutory references that accompany the lemmata are the same. The parallels in the headings include such unusual items as a mysterious lemma ‘Novelx’ (MS 40, fol. 9v; MS 170, fol. 309v), a garbled abridgement of the statutes of Richard II that followed the Peasants’ Revolt (MS 40, fol. 13r; MS 170, fol. 316r), and a correction of a statutory reference from 4 Hen. 4 to 5 Hen. 4 (MS 40, fol. 9r; MS 170, fol. 308v). The exceptions in the lemmata are ‘Hunters’, citing 13 Ric. 2 [stat. 1] c. 16 (MS 40, fol. 7v) and ‘Corone de Royalme Taille’, citing 7 Hen. 4 c. 2 (MS 40, fol. 4v), neither of which in MS 170. The lemma ‘Hunters’ is already in both manuscripts as ‘Veners’ (MS 40, fol. 12v; MS 170, fol. 315v), citing 13 Ric. 2 c. 14 (c. 13 in S.R.). ‘Hunters’ and ‘Corone de Royalme Taille’ could well have been later additions to MS 40. MS 170 seems to be slightly earlier than MS 40 (MS 170, last statute 8 Hen. 6, itself a later addition; MS 40, last statute 23 Hen. 6, with a later addition of 1 Edw. 4). The only things so far discovered in the index in MS 170 that are not in MS 40 are two additional citations to statutes in what is obviously a different hand (MS 170, fol. 314v, under ‘Usure’).

It seems likely that both indices are derived ultimately from a common source that was made shortly after 3 Hen. 5 (1415–16). This common source also seems to have been in fairly wide circulation. MS 185 shares many, but not all, of the same lemmata and statutory citations, but MS 185 has additions to and subtractions from the base text. (See the Introduction to MS 185.)

There are five other examples of this writ in our collection, no two of which have the same date. Three of them are addressed to the mayor and bailiff of York; one lacks an addressee, and one is addressed to the mayor and sheriffs of London.   Note: The abridgement of the statute beginning ‘Pardon’ is quite curious. There is no statute of 10 Ric. 2 that deals with this issue. What the abridgement seems to be is a rather jumbled abridgement of 5 Ric. 2, c. 5 and 6. Chapter 5 contains the pardon (extended in 6 Ric. 2, c. 3); chapter 6 what is in effect the annulment of instruments made under duress during the time of the Peasants’ Revolt.
