TRACTATUS UNIVERSI IURIS (VENICE 1584–86) CONTENTS Tome 1

Tome 1 of TUI 1584 is devoted to the history of law and to law in general. It bears the subtitle De iure cognoscendo et interpretando (‘On knowing and interpreting the law’). It contains a number of works of humanist jurists and gives us some sense of the methodological debates that were going on in the sixteenth century.

Before we get to the tome, there is bound with it in our copy ‘front matter’ that could have been bound separately. It begins with a separate title page for the entire series of tomes, a dedicatory epistle to Pope Gregory XIII, a brief note to the reader, and tables listing all of the authors in the tomes and all of the titles in the tomes. The signatures indicate that it was decidedly separate from tome 1: The title page, the dedicatory epistle, and note to readers are a terrnion, marked only by *2 on sig. *2r; the list of authors is a ternion, marked with **, **2, and **3; and the index of titles is a quinternion, marked by ***, ***2, ***3, ***4, and ***5. The opening signature of the tome proper has its own title page with an index of authors in the tome on the verso. It is preceded by two blank pages, probably designed as a pastedown for vol.. 1. The first signature marking is on the first marked fol., 3r: A3. The register at the end of the tome ignores the front matter, and tells us, as seems to be accurate, that the tome contains signatures A-Z, Aa-Zz, and Aaa-Eee, all of which are quaternions, except for the last which is a duernion. The signature markings in the page delivery service and below fill out what is found in the tome without distingushing between what is actually there and what we have added.

The list of titles and authors follows the format outlined in the introduction to these pages. It seems particularly unlikely that we missed any item in this tome, because we checked quite systematically for the one item which is identified to this tome in the HOLLIS catalogue, but which does not appear there. (This is listed at the end of the table.)

The heading abbreviations and the bibliographical abbreviations are the same as those used throughout these pages.

After the list of authors and titles there is another list that gives the formal ‘metadata’ of the tome.

Preliminary work on this list was done in the summer of 2013 by Dennis Mahoney and in the summer of 2014 by Shuting Lu. The Ames Foundation is grateful to both of them for their devotion to the task. Errors, which certainly exist and which are my responsibility, can be called to our attention by sending us an email.

TOME 1 – AUTHORS AND TITLES

HOLAU TUIAU TUITI HN Vol. Fol. Seq.
item no. 1 Du Rivail, Aymar, ca. 1490–1557 Aymarus Rivallius Allobrigis  Iuris civilis historia 4192425 1 3ra 48
note Rivail, Aymar du, c. 1490 – 1557. The HOLLIS record is for the ed. Lyon 1551. HOLTI: Aymari Rivallii ... Ciuilis historiae iuris, siue in xii. tab. leges commentariorum libri quinque, iam denuo diligenter recogniti. Historiae item iuris Pont. liber singularis.
item no. 2 Forster, Valentin Wilhelm, 1574–1620 Valentinus Forster De historia iuris civilis Romani, libri tres 4313548 1 25vb 93
note Forster, Valentin, 1530–1608. The HOLLIS record, which is for the edition of Helmstedt of 1610, has the wrong author. This one is Valentin without Willhelm, 1530–1608.
item no. 3 Coras, Jean de, 1513–1572 Ioannes Corasius De iuris arte liber, quatuor partibus conclusus 4302355 1 59ra 160
note Coras, Jean de, 1513–1572.
item no. 4 Hoppers, Joachim, 1523–1576 Ioachimus Hopperus De iuris arte, libri tres 1711124 1 81va 205
note Hoppers, Joachim, b. Sneek 1523, d. Madrid 1576.
note Pelleus, Ludovicus, 16th c. The syntax of the title is a bit odd.  Asservere is probably a shortened form of asseraverunt. More seriously, we would expect iuri civili artis aut scientiae titulum non esse donandum. But that is not what it says.
item no. 6 García, Fortunius, 1494–1534 Fortunius Garcia De ultimo fine iuris canonici et civilis 4313487 1 105vb 253
note García, Fortunius, 1494–1534.
item no. 7 Gammaro, Pietro Andrea, 1480–1528 Petr[us] And[reas] Gammar[us] De veritate ac excellentia legalis scientiae libellus 4312947 1 132ra 306
note Gammaro, Pietro Andrea, b. Casalfiumanese 1480, d. ?Viterbo 1528.
item no. 8 Placentinus Placentinus De senatusconsultis tractatus 4350910 1 135rb 310
note Placentinus, b. Piacenza 12/1 c., d. Montpellier c. ?1181/2. Whether P. wrote this treatise is a matter about which we may have some doubt. It is possible, however, that it is derived, at one or more removes, from genuine works of his, all of which are listed in Lange, Glossatoren, 211–14.
item no. 9 Angleberme, Jean Pyrrhus d’, ca. 1470–1521 Pyrrhus Angleberme De magistratibus Romanis libri tres 4188179 1 135va 313
note Angleberme, Jean Pyrrhus d’, b. Orléans c. 1470, d. Milano 1521.
item no. 10 Cotta, Catellianus Catellianus Cotta De iurisperitis 4305797 1 137va 317
note Cotta, Catelliano, fl. 1512 – d. Milano 1553. Renzo Villata (DGI, 1.601) compares this work to that of Aymar Du Rivail, above, fol. 3ra.
item no. 11 Rutilio, Bernardino, 1504–1538 Bernardino Rutilio Iurisconsultorum vitæ 4358738 1 139va 321
note Rutilio, Bernardino, b. Bologna 1504, d. Venezia 1538.
note Fichard, Johann, b. Frankfurt 1512, d. Frankfurt 1581. HOLTI reads (male): docendo er scribendo.
item no. 13 Massa, Antonio, 16th cent. Antonio Massa De exercitatione iurisperitorum 4341907 1 168vb 379
note Massa, Antonio, b. Gallese 1500, d. Roma 1568. Exercitatio probably has the sense here of ‘practice’, perhaps even of ‘training’.
item no. 14 Cipolla, Bartolomeo, d. ca. 1477 Bartolomeo Cipolla De cognitione librorum iuris canonici 4288353 1 181va 405
note Cipolla, Bartolomeo, b. Verona c. 1420, d. Padova 1475.
item no. 15 Douaren, François, 1509–1559 Franciscus Duarenus Epistola ad Andream Guillartum,  de ratione docendi, discendique iuris conscripta 4299653 1 183rb 409
note Douaren, François, 1509–1559. Guillartus is described in the title as clarissimi viri Andree Guillarti, libellorum in regia magistri filium. He is probably André Guillard du Mortier (c. 1517–1579) (French Wikipedia), son of André Guillard (c. 1495–1568) (French Wikipedia), maître des requêtes de l’hôtel du roi (the name is also spelled with a ‘t’). Regia here may refer to a ceremonial door (see Niermeyer, s.v.), but probably curia is to be understood. This work is said to be the first clear statement of the mos gallicus, the French method of dealing with legal texts from the past.
item no. 16 Joannes Baptista, de Sancto Blasio Baptista a Sancto Blasio Tractatus insignis et rarus contradictionum iuris canonici cum iure civili 4321200 1 185ra 413
note Battista da Sambiagio, b. Padova c. 1425, d. ?Verona ?Brescia 1492.
item no. 17 Galvanus, de Bononia, fl. 1361–1384 Galvanus Boniniensis Differentie legum et canonum 4312913 1 189ra 421
note Becchini, Galvano, b. Bologna 14/1 c., d. Bologna a. 1395.
item no. 18 Prosdocimus de Comitibus Prosdocimus de Comitibus De differentiis inter ius canonicum et ius civile 4351385 1 190rb 423
note Conti, Prosdocimo, b. Padova c. 1370, d. Padova 1439.
item no. 19 Zanetinis, Hieronymus de Hieronymus de Zanetinis Tractatus de differentiis inter ius canonicum et civile 4376139 1 197vb 438
note Zanettini, Girolamo, b. Bologna ... , fl. 1457 – d. Bologna 1493. Guerrini (DGI 2.2081–2) argues that this treatise is more sophisticated than either of the two preceding.
item no. 20 Federicis, Stephanus de Stephanus de Federicis Brixiensis De interpretatione legum 4309067 1 208va 460
note Federici, Stefano, b. Sonico sec. 15 ineunte, d. a. 1496.
item no. 21 Baudouin, François, 1520–1573 Franciscus Balduini Commentarius de legibus XII tabularum 4191912 1 225vb 494
note Bauduin (Baudouin), François, b. Arras 1520, d. Paris 1573. This work is an example of the method of palingensia, reconstructing older works from the surviving fragments in the Corpus Iuris, a method which B. is said to have invented.
item no. 22 Reyvaert, Jacob, ca. 1535–1568 Iachobus Raevardus Ad leges XII tabularum 4354889 1 244ra 531
note Raevardus (Reyvaert), Jacobus, c. 1535–1568. The HOLLIS record is for another work by the same author.
item no. 23 Zasius, Johann Ulrich, 1521–1570 Ioannes Ulricus Zasius Catalogus legum antiquarum una cum adiuncta summaria interpretatione 4382970 1 252va 548
note Zasius von Rabenstein, Johann Ulrich, b. Freiburg im Breisgau 1521, d. 1570.
item no. 24 Le Caron, Louis, 1534–1613 Ludovicus Charondas Ad leges duodecim tabularum liber singularis 4327101 1 267va 578
note Caron (Charondas), Louis le, 1534–1613.
item no. 25 Ulpian Ulpian XXIX tituli ex corpore Ulpiani ad veterem manuque scriptum Philippi Gervasii Iureconsulti Germani codicem restituti et emendati. In eosdem titulos Ludovici Charondae et Iacobi Cuiacii Iureconsultorum notae 4368902 1 271va 586
note Ulpian, d. 223AD. HOLTI reads (male): manusque. The annotators are the well-known humanist jursits Louis le Caron (Charondas) (1534–1613) and Jacques Cujas (1522–1590). The legal humanists were fascinated by the fragments of Roman law that exist outside of the Corpus Iuris Civilis, because they quite rightly thought that they might allow us to check how closely the Corpus follows the original texts that it purports to quote. What relationship this work bears to that of the Roman jurist Ulpian is still controverted today, but it certainly antedates the compilation of the Justinianic Corpus.
item no. 26 Corso, Rinaldo, 1525–ca. 1581 Rainaldus Corsus Indagationum iuris libri III 4302975 1 279vb 602
note Corso, Rinaldo, b. Verona 1525, d. Strongoli 1582. Indagatio, a rare word, meaning ‘investigation’.
item no. 27 Bolognetus, Albertus Albertus Bolognetus De lege, iure et aequitate disputationes 4291027 1 289rb 621
note Bolognetti, Alberto, b. Bologna 1538, d. Villach 1585.
item no. 28 Joannes a Capistrano Ioannes a Capistrano Speculum conscientiae 4321104 1 323vb 690
note Giovanni da Capestrano, b. Capestrano 1386, d. Ilok 1456.
item no. 29 Le Rouillé, Guillaume, 1494–ca. 1550 Guillelmus Le Rouille Alenconiensis De iustitia et iniustitia 4327394 1 371va 786
note Rouillé, Guillaume le, 1494-c. 1550. HOLTI reads (male): Iusticie et iniustitia.
item no. 30 Not in HOLLIS Constantinus Rogerius De iuris interpretatione 1 386ra 815
note Rogerius, Constantius, fl. 1463. Lange/Kriechbaum, Kommentatoren 349, date this work to around 1463.
item no. 31 Not in HOLLIS Constantius Rogerius In § de viro l. si vero ff. soluto matrimonio [D.24.3.64.9] eruditisimi commentarii 1 394va 833
note Rogerius, Constantius, fl. 1463. This item is probably designed to illustrate the previous one.
item no. 32 Not in HOLLIS Constantinus Rogerius De legis potentia 1 395rb 833
note Rogerius, Constantius, fl. 1463.
item no. __ Gambarus, Petrus Andrea Not in TUI 1584 Not in TUI 1584 1711039 1
note Gammaro, Pietro Andrea, b. Casalfiumanese 1480, d. ?Viterbo 1528. HOLLIS notes that a work by this author entitled De modo disputandi ac ratiocinandi in jure liber primus is found in TUI 1584. It is not, though it is found in Tractatus 1549. STC attributes it to Gambari, Pietro Andrea. HOLLIS adds to the citation of TUI 1584:  27 folio, pp. 278–190, which makes no sense.
